Whistleblowing

On December 29, 2017, Law No. 179, "Provisions for the Protection of Reporters of Crimes or Irregularities of which they have become aware in the context of a public or private employment relationship," came into force. This law aims to encourage worker cooperation to facilitate the emergence of corruption within public and private entities. This law addresses the call made to Italy by several international anti-corruption organizations to strengthen its prevention and fight against this phenomenon, including by establishing systems that allow workers to safely report any unlawful conduct they become aware of.

The regulatory framework was further enhanced by the enactment of Legislative Decree No. 24 of March 10, 2023 (published in the Official Journal on March 15, 2023), with which the national legislator implemented EU Directive No. 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons reporting breaches of Union law and laying down provisions on the protection of persons reporting breaches of national legislation. This regulation takes effect on 15 July 2023.
